1. Agreement and platform operator
These Terms of Use form an agreement between you and Klik for access to the Klik website, marketplace, accounts, auctions, wallet ledger, subscription, deposit, and withdrawal features. By creating an account or using Klik, you agree to these terms and the policies linked from them.
If you do not agree, do not create an account, join an auction, place a bid, or use a paid feature. Additional terms presented for a payment provider or a specific service also apply to that service.
2. Eligibility and your account
- You must be at least 18 years old, able to enter a binding contract, and legally permitted to use the service where you live.
- You must provide accurate, current information, verify your email address when requested, and keep your account information up to date.
- You are responsible for your password, devices, sessions, and recovery codes. Contact Klik promptly if you suspect unauthorized access.
- Your account is personal. You may not sell it, transfer it, share it to avoid platform controls, or create multiple accounts to manipulate an auction.
- Professional sellers must identify and comply with their status, disclosures, taxes, warranties, returns, and other duties under applicable law. A buyer's statutory rights may differ depending on whether the seller is a trader or a private individual.
3. Klik's role
Klik provides technology for users to list products and participate in auctions. Unless a listing expressly says otherwise, Klik is not the seller, buyer, owner, manufacturer, carrier, inspector, or agent for a listed item. The sale resulting from an auction is between the seller and the winner.
Klik does not independently guarantee an item's identity, ownership, condition, safety, legality, authenticity, delivery, or fitness for a particular purpose. We may review or remove content and investigate activity, but that does not replace each user's responsibility to make reasonable checks.
4. Publishing and joining auctions
Seller rules
Submitting a standard auction for review is free. A new submission remains private until a Klik administrator approves it, and Klik may reject listings that are incomplete, prohibited, unsafe, misleading, or otherwise unsuitable for the marketplace. Approval is a platform moderation decision, not a guarantee of the item. The seller chooses the product information, starting price, start and end times, entry fee, minimum participant count, and bid increment. The seller must own the item or have authority to sell it and must describe its condition, material defects, total delivery expectations, and any lawful restrictions accurately.
A seller may not join or bid in their own auction. Once users have committed credits, Klik may restrict material changes or cancellation to protect participants and marketplace integrity.
Joining rules
To participate, you must join before the cutoff displayed for the auction. The current platform cutoff is 5 hours before the scheduled start. The stated entry fee is debited from your available credits when you join, and the transaction appears in your ledger.
If the minimum participant count is not reached when the auction is due to start, the auction does not proceed and participant entry fees are returned automatically as credits. If a live auction ends without a winning bid, participant entry fees are also returned and reserved bid credits are released.
5. Bids and auction results
Every bid is an offer to buy the item at the submitted amount. A valid bid is binding and cannot ordinarily be withdrawn. You must review the listing, seller information, delivery arrangements, and total commitment before bidding.
Klik reserves the highest bid amount from the bidder's credit balance so it cannot be spent elsewhere. When another valid bid becomes highest, the earlier highest bidder's reservation is released. When the auction ends successfully, the winner's reserved amount is captured and the seller and winner must complete the transaction.
Klik may delay, reject, cancel, or reverse activity affected by a technical error, duplicate transaction, security incident, prohibited conduct, suspected fraud, legal requirement, or manifest pricing error. Any corrective ledger entries will be recorded.
6. Credits, deposits, fees, and settlement
Credits and deposits
Klik credits are an internal, euro-denominated accounting balance used on the platform. One euro of confirmed value is represented as one euro of credits. Credits are not cryptocurrency, an investment, a bank account, or an interest-bearing deposit, and they may only be used or withdrawn through the available Klik features.
Deposits may be processed by a payment provider or verified manually. Provider terms, identity checks, limits, exchange costs, card fees, or bank charges may apply. Credits are added only after the payment is confirmed.
Standard service fee
When a standard auction ends with a winner, Klik charges the seller a service fee equal to 10% of the winning bid. The seller's settlement consists of the winning bid minus that service fee, plus the valid entry fees paid by participants. The ledger records the settlement and fee.
Seller subscription
The optional seller plan costs €49.00 for one month. Auctions published while the plan is active record a 0% Klik service fee, even if the plan later expires. Payment-provider, card, bank-transfer, withdrawal, tax, or other third-party charges may still apply.
The current plan is purchased using available credits and runs for the stated month; it does not automatically renew unless Klik later presents a separate renewal choice that you expressly accept.
7. Withdrawals
You may request withdrawal of available credits to a supported bank account. The requested amount is debited when the request is submitted and remains subject to review, verification, limits, security checks, and lawful compliance requirements. You must provide accurate account-holder, IBAN, and BIC/SWIFT information.
If Klik rejects a withdrawal, the full debited amount is automatically returned to your credit balance. Once a transfer is marked paid, banking timelines and any receiving-bank or intermediary fees are outside Klik's control.
8. Delivery, returns, and user responsibilities
The seller and winner are responsible for agreeing on payment completion, collection or shipping, insurance, delivery cost, transfer of title and risk, and any inspection or acceptance process not provided directly by Klik. Sellers remain responsible for legally required remedies, guarantees, withdrawal rights, and product-safety obligations.
Products must not be illegal, stolen, counterfeit, unsafe, recalled, misleadingly described, or subject to sale restrictions the seller cannot satisfy. Prohibited conduct includes bid manipulation, collusion, shill bidding, harassment, scraping, malware, payment abuse, chargeback fraud, impersonation, evading limits, exploiting errors, or interfering with another user's access.
The Refund Policy explains platform credit reversals and non-refundable charges. It does not remove any non-excludable consumer right or a buyer's claim directly against a seller.
9. Listings and intellectual property
You retain ownership of content you submit. You give Klik a worldwide, non-exclusive, royalty-free license to host, store, reproduce, format, display, and communicate that content as reasonably needed to operate, promote, secure, and improve the marketplace. The license ends when the content is no longer needed, subject to backups, legal retention, completed transaction records, and material already shared lawfully.
You must have all rights needed for your text and images. You may not infringe copyright, trademark, privacy, publicity, database, or other rights. Klik's software, visual identity, trademarks, and original platform content remain owned by Klik or its licensors.
10. Enforcement and service availability
Klik may investigate, hide listings, restrict transactions, hold a withdrawal for review, suspend or close an account, preserve evidence, or report conduct when reasonably necessary to protect users, enforce these terms, prevent fraud, respond to a security issue, or comply with law. Where appropriate, we will provide notice and a way to contact support.
We work to keep Klik available and accurate, but uninterrupted or error-free operation cannot be guaranteed. Features may be changed, paused, or discontinued for maintenance, security, legal, or product reasons. We will use reasonable care when correcting a platform error that affects credits or an auction result.
11. Liability, applicable law, and changes
To the fullest extent permitted by law, Klik is not responsible for indirect or unforeseeable loss, user-supplied content, a seller's item or conduct, failed delivery, or events outside reasonable control. Nothing in these terms excludes liability that cannot legally be excluded, including liability for fraud, deliberate misconduct, or other mandatory protections.
You remain responsible for losses and reasonable costs caused by your unlawful content, fraud, or material breach of these terms, to the extent permitted by law. Any limitation in these terms is subject to mandatory consumer rights in your country.
The law and courts governing this agreement are determined by the operator's establishment and applicable conflict-of-law and consumer-protection rules. The operator must publish its governing-law details before production launch.
We may update these terms to reflect service, fee, security, or legal changes. Material changes will be communicated appropriately and will apply from the stated effective date. Changes do not retroactively alter an already completed settlement unless required by law or needed to correct fraud or a platform error.
